Slain Baltimore officer's family sues department

BALTIMORE - The family of a plainclothes Baltimore police officer killed by friendly fire as officers tried to break up a fight outside a nightclub has filed a wrongful death lawsuit against the department.

  The Daily Record reports ( ) that the suit filed Wednesday by the family of William Torbit Jr. also names four officers and the then-acting district commander. It seeks unspecified damages.

Torbit responded to a report of trouble at the Select Lounge early on Jan. 9, 2011 and investigators determined he fired shots as he was stomped by a group of people.

Uniformed officers -- not knowing Torbit was an officer -- fired dozens of shots, killing Torbit and wounding four others.  Investigators say Torbit likely shot and killed Sean Gamble, whose family filed a wrongful death lawsuit Monday.
