O'Malley signs death penalty repeal

ANNAPOLIS, Md. - Governor Martin O'Malley has signed the Death Penalty Repeal, and will sign more than 200 other bills into law today.

Maryland is the 18th state to repeal capital punishment.

Maryland currently has five men on death row.  This measure will not apply to them retroactively, but the legislation will allow the governor to commute their sentences to life in prison without the possibility of parole if he wants.

In an Associated Press report O'Malley has said he will consider them on a case-by-case basis.

Maryland has not executed anyone since 2005, when Republican Gov. Robert Ehrlich was in office.
