Maryland is working to dismiss allegations in a federal lawsuit that it contributed to the wrongful death of a man with down syndrome.
Robert Saylor suffocated while in custody of 3 Frederick County sheriff's deputies who were moonlighting as mall security guards.
The attorney general's office said Saylor was arrested because he was trespassing, stealing and disobeying police.
The 26-year-old died in January of last year as deputies tried to remove him from a movie theater because he didn't have a ticket.
