BALTIMORE - It's been nearly a year since Tyrone West died in police custody . Now his family is heading to court.
West’s family has filed a wrongful death and excessive force lawsuit. West died in police custody last July after he was pulled over on Kelway road in Northeast Baltimore.
For months his family and witnesses who saw the arrest claimed the officers used excessive force which may have caused his death. But the state's attorney ruled those claims weren't true and said the officers acted within the guidelines and they would not be charged.
The family's attorney, A. Dwight Pettit, says they've seen this before.
"We believe there's policies and procedures which are allowing this conduct to continue and persist in Baltimore City,” Pettit said.
Pettit is also representing the family of Abdul Salaam in a separate excessive force case.
