Man accused of killing 3-year-old McKenzie Elliott in court

Three years after the death of toddler McKenzie Elliott, the man accused of killing her is due in court. 

On Tuesday, Terrell Plummers' attorneys will argue that the government is withholding documents related to this case.

3-year-old McKenzie Elliott was shot and killed in the crossfire during a turf battle back on August 1, 2014. She was hit by a stray bullet while standing on a porch in Waverly. 

28-year-old Terrell Plummer was arrested back in April for her murder.

Before Plummer was arrested there was a lot of community outcry about solving this case. Police originally arrested the suspect at that time, Tyrone Jamison.

Jamison was never charged with Elliott's murder.

Now, Plummer's attorneys are calling for more information on witnesses who identify Plummer as the shooter.

Prosecutors say their theory is that Plummer carried out the shooting to protect the gang's drug territory.

Eight other members of Plummer's Old York Money Gang could also face drug-related offenses. Plummer could face the death penalty or life in prison.
