The parents of an elementary school student who was suspended for eating his pastry into a handgun was petitioning to have the boy’s record cleared.
A hearing on the issue was held Wednesday afternoon. So far, no decision has been reached.
Josh Welch was in second grade at Park Elementary School in Anne Arundel County when the incident occurred in March of last year.
His teacher said it wasn't that he made a fake gun, it was that the boy was disruptive and it wasn't his first time.
The school said he'd been disruptive in the past and this was just the final straw.
Watch the video to hear from school officials and the family’s legal counsel.
Josh Welch is now in fourth grade at a different school.
