Josh Welch was in second grade at Park Elementary School in Anne Arundel County when the incident occurred in March of last year.

His teacher said it wasn't that he made a fake gun, it was that the boy was disruptive and it wasn't his first time.

Josh Welch is now in fourth grade at a different school.
