A grand jury indicted a Baltimore Police officer for assault and misconduct in office Wednesday.

Police said the case against Donald B. Gaff, an officer with three and a half years with the department, was opened after Gaff was seen using what appeared to be unjustified force when arresting a man on Sept. 11 on East Patapsco Avenue.

Police were doing a routine review of body camera footage when they saw Gaff's alleged actions.

Gaff's police powers have been suspended, and he has been served with a criminal summons. He had been assigned to the Southern District patrol division.

“This incident again demonstrates our capacity and willingness to hold police officers engaged in misconduct accountable,” Baltimore Police Commissioner Kevin Davis said in a news release. “His actions do not represent the professionalism exhibited by the men and women of the Baltimore Police Department on a daily basis.”

The body camera footage of this incident will not be released. It was turned over to the State’s Attorney’s Office as part of the investigation.
