The man convicted of strangling his ex-girlfriend nearly two decades ago is asking to be out of jail on bail. 

Adnan Syed's lawyers say since a judge granted a new trial, Syed should be allowed to be released -- they also say he wouldn't be a danger to the community.

In addition to that, Syed's attorney says he has no history of violence other than the state's claims in the case and hasn't had any issues since he's been in jail. 

Syed's attorney, Justin Brown, filed a motion in Baltimore City Circuit Court on Monday. 

Adnan Syed was convicted and sentenced to life plus 30 years in prison in the year 2000 for murdering his ex-girlfriend Hae Min Lee when they were students in high school. 

A judge threw out the conviction this summer and ordered a new trial after Syed's then attorney didn't cross examine a cell tower expert. 

Details about cell phone tower information and Syed's location are being questioned. 

Brown said because Syed's conviction was vacated and a new trial was ordered, Syed is entitled to be released as any other newly charged defendant appearing before the Circuit Court. 

According to the motion, Brown writes that a social worker is working with Syed on the possibility of being released and has also vetted locations where Syed could live until his re-trial. 

That social worker will continue to work with him during that time. 

Only a judge has the power to grant a release.

ABC2 News has reached out to the state. A spokeswoman said they haven't yet received the motion and won't proceed until they read over what the defense wants.
