Assault charges dropped against prison guard

CUMBERLAND, Md. (AP) - Prosecutors have dropped assault charges against a Maryland correctional officer for an incident in which an inmate was injured at the North Branch Correctional Institution near Cumberland.

Court records show that two counts of second-degree assault against David Robey were dropped during a hearing Thursday in Cumberland.

He and fellow officer Warren Mallow were charged in September for an incident in which a handcuffed inmate allegedly was beaten in a cell. The inmate allegedly suffered a broken wrist and had his head slammed into a wall.

Robey's defense attorney says video of the incident showed that Robey used the amount of force necessary to gain the inmate's compliance.

Mallow's trial is set for Feb. 14.

Both officers are five-year veterans of the state Division of Correction.
