Should Attorney General Eric Holder be held in contempt of Congress?

WASHINGTON - A House committee is trying to decide whether to hold Attorney General Eric Holder in contempt of Congress over the Justice Department's flawed gun smuggling probe, operation fast and furious.

Yesterday for the first time President Obama used the executive privilege to withhold hundreds of documents related to the flawed fast and furious gun running program. These documents are at the center of the standoff between Attorney General Eric Holder and House oversight committee chairman.

The plan was to dump weapons into Mexico to find high level drug dealers, but the agency lost track of hundreds of guns.

Some weapons were recovered from crime scenes in the U.S. and Mexico, including the scene of Brian Terry's murder.

He was a U.S. border patrol agent killed in a shootout, which led agents to blow the whistle on the botched operation.

Congressman Elijah Cummings is a ranking member of the oversight and government reform committee and had this to say about the recent events.

"It seems to be a presumption that when certain privileges are asserted, certain concerns are raised by the attorney general with regard to deliberative documents, things that go on between staff and things that have traditionally been privileged that suddenly he has to be hiding something,” said Cummings.

"So you know this whole idea…what he's hiding," said Cummings. "Well I don't think he's hiding a damn thing."

Former Baltimore native and House Minority Speaker, Nancy Pelosi said the following to reporters yesterday in reference to the holder controversy:

"I could have arrested Karl Rove on any given day. I'm not kidding. There's a prison here in the capitol ... If we had spotted him in the capitol, we could have arrested him."

Republicans say the president using executive privilege implies the White House is covering something up and now they have more questions.

There could be a vote in the full house sometime next week unless there is a resolution in the meantime.
