Prosecution rests in Huguely murder case

6:30 p.m. Wednesday - Just finished watching Dave Chapman cross-examine the defense brain expert. Money quote was at the end...

Dr. Jan Leestma - "There's science there. A lot of it" Chapman - "I wish you could refer us to it"

Chapman also asked how much the doctor has been paid for his testimony.. Answer was $8000, so far

Chapman-"Why didn't you write a report on this case?" Dr. Jan Leestma "I was not asked to"

Chapman-"If you did (write a report) you'd have to put your name on it and sign it" Dr. Jan Leestma -"I could do that, they have not asked me"

4:40 p.m. Wednesday - Dr. Jan Leestma - She's the defense's brain expert.  She traveled to Richmond to look at Yeardley love's brain.  She said there was swelling in some areas of Love's brain. 

Defense brain expert attributes Yeardley Love's death to deprivation of blood flow and oxygen to the brain, probably asphyxia.  The claim is consistent with defense's argument that Love died from passing out in her bed and being unable to breathe. 

Prosecutor Chapman is extremely animated in his cross examination of the defense's brain expert.

2:59 p.m. Wednesday - Defense's first witness - Alphonse Poklis, Toxicologist - Poklis studied at the University of Maryland and worked at the medical examiner's office in Baltimore.  He says Love's blood alcohol was .14 at her death, it would have been .16 or above shortly before she was alive.

2:24 p.m. Wednesday - Defense motion - Defense moves to strike all charges against George Huguely, except for grand larceny.  The defense's overall argument is, as we've reported, that there is no intent.  The judge denies the motion.

2:19 p.m.  Wednesday - Commonwealth rests.

12:46 p.m. Wednesday - Lunchtime - The prosecution ready to rest its case, but taking lunch to make sure all evidence is in order.  

12:35 p.m. Wednesday - Prosecution's final witness, Charlottesville Detective Michael Flaherty -  He was brought up for one specific purpose to show a photo from the crime scene.  It's the last impression jurors will have before the defense lays out its case.

12:29 p.m. Wednesday - Megan Moses - She met Huguely at a concert one week before Love's death.  She says Huguely called her around midnight.  That's very close to Love's time of death. 

12:01 p.m. Wednesday - William "Mikey" Thompson - Thompson said after the golf tournament, Huguely was drunk, not walking straight, slurring words.  Thompson was at dinner with Huguely & others after the golf tournament. He says Huguely peed on the side of a building after dinner.

Thompson was asked about Huguely's drinking.  He said, "The drinking had gotten out of control and it needed to stop."

11:46 a.m. Wednesday - Cross-examination of Clements - Clements says the incident where Huguely jumped on him was good-natured and playful. Huguely told his friends he'd stopped by Clements apartment, when he had actually gone to Love's apartment.

11:32 a.m. Wednesday - Chris Clements, former Virginia lacrosse player - Clements ssays he knew Yeardley Love since grade school.  Clements is from Baltimore and attended St. Paul's.  Clements saw the choking incident and said Love was very disturbed. 

On the morning of the golf tournament, Clements was in bed with his girlfriend.  He says Huguely jumped on the bed and held Clements down so he couldn't move.  The girlfriend pulled the sheets up around her.  Huguely let Clements up and they went to the golf tournament.

Clements played in a foursome with Huguely and Huguely's Dad.  Clements says Huguely wasn't "fully participating" by the final three holes.  

Later that night, Clements saw Huguely and says he was still drunk.  

Clements was working on a paper and says he did not drink at all that day.

Around 11:30 Sunday night, Clements says Huguely tried to get into his bedroom.  Clements locked the door and told him to go away.

Clements worked on his paper all night.  Around 2:30 or 3, he walked outside and saw police lights. But he didn't think anything of it.

 

10:48 a.m. Wednesday - Ken Clausen, neighbor - Clausen lived in an apartment near Huguely and Carroll.  Clausen saw Huguely drinking at the Sunday golf tournament.  Clausen rode went to dinner with Huguely, Huguely's father and other players after the tournament. He says Huguely was drunk.      

Clausen says Huguely was frustrated that his dad had been getting him to sign "some kind of papers" related to a graduation gift.

Huguely told Clausen that the friend downstairs, Chris Clememts, was drunk. He and Carroll didn't believe it.

The prosecution is trying to establish that Huguely lied about where he'd been when he went to Love's apartment.  Clausen says, "When we figured out that what he was saying wasn't adding up, I asked him 'What's wrong with you?'  I got no response."

Clausen was asked about Huguely's drinking.  He said,  "It was getting

to a point where it seemed kind of ridiculous." 

Clausen says, "We would be doing the same thing, he would be more belligerent."

Clausen says he and Kevin Carroll discussed talking to Huguely about his drinking the next day.
