--“The Board found that the physician sold, prescribed, gave away or administered drugs for illegal or illegitimate medical purposes, is guilty of unprofessional conduct in the practice of medicine and that he failed to meet the standard of quality care.”
--“The Board determined that the matter required emergency action based on pending criminal charges relating to controlled dangerous substances and a peer review of 12 patients in which the reviewers found that the physician failed to meet the standards of quality care in regard to all 12 patients.”
--“An undercover operative from the Montgomery County Police Department posing as a patient arrived at the Respondent’s medical office for a scheduled appointment and received prescriptions for 3 CDS: 30 tablets of Oxycontin 80mg, 60 tablets of Percocet 10mg and 15 tablets of Xanax.
According to the operative, he did not provide a legitimate purpose for the CDS…the operative returned to the Respondent for a second visit and, after a short conversation without any physical examination, the Respondent again prescribed 30 tablets of Oxycontin, 60 tablets of Percocet and 15 tablets of Xanax.”
--“Patient C testified during her interview that she did not have any back pain when she went to see the Respondent. She stated that one of her friends, who was “cool with Dr. Gamez, urged her to visit him. According to Patient C, the friend needed people to visit the doctor to receive pain medications.”
