BALTIMORE - The Maryland Attorney General's office has issued a final decision in a civil case brought against an Annapolis paver ABC2 News Investigators have been tracking for more than a year. The office's Consumer Protection Division found Tommy Clack, 40, preyed on consumers in Maryland by offering either no estimate or a low-ball estimate for driveway paving services. Officials say Clack then jacked up the price by thousands of dollars in some cases.
The decision finds Clack in violation of the Maryland Door-to-Door Sales Act and orders him to pay $204,527 in restitution to 14 Maryland consumers whose driveways he paved while operating without the proper state licensing. Clack has also been ordered to pay $284,000 in civil penalties, a total which equates to $1,000 for each of the 284 days the Consumer Protection division found he operated in Maryland.
According to the decision paperwork, Clack has also been ordered to cease and desist offering or selling any home improvement services until he gets the proper licensing. Clack will also have to obtain a $50,000 to protect any future customers who may decide to use his services as a paver.
Tommy Clack was arrested in South Carolina on outstanding warrants three weeks ago. He was extradited back to Maryland last week and is currently being held in Anne Arundel County on fugitive warrants. Clack faces criminal charges in Anne Arundel, Baltimore, Prince George's and Queen Anne's counties.
