Worcester County prosecutors have dropped salvia possession charges against one Ocean City retailer after he argued that the charges weren't fair.

Deputy State's Attorney Paul Haskell said Wednesday that he dropped charges because of the recent enactment and circumstances in the case.

The Ocean City Town Council outlawed the hallucinogenic herb on Aug. 3. During compliance checks the next day, police charged Loron Katna of Ocean Wave with possession. Katna said in a letter that he had leftover salvia waiting to go back to the distributor.

Police had previously incorrectly stated that Ocean Wave employee Benjamin Lugasi had been charged with salvia possession. Two other Boardwalk retailers, Sharon Cohen of Ocean Beachwear and Itzak Algave of The Rave, were charged with salvia possession and have been assigned court dates next month.
