Food trucks sue city over 300-foot proximity ban

Baltimore food truck owners are suing the city over a law that bans trucks from operating within 300 feet of any brick-and-mortar business selling the same type of food or merchandise.

The law was enacted in 2014 and comes with a $500 fine with the possibility of having a license revoked.

Food trucks including Pizza di Joey and Madame BBQ teamed up with Institute for Justice (IJ) to challenge the ban which they said in a news release, “makes absolutely no sense-and it is unconstitutional.”

Vendors said the ban is unfair and restricts sales throughout the Baltimore area.

“So while a taco truck would be banned from operating near a Mexican restaurant, a gyro truck could park right out front,” the group said.
